Many of us are aware that the Voting Rights Act, signed into law by President Lyndon Johnson in 1965, was passed in order to prohibit state and local government from imposing laws that discriminate against racial or language minorities. What is less well known is that the Act isn't now, nor ever was, sufficient to protect minorities' right to vote, and that Congress was subsequently forced to amend the Act and expand its protections in 1970, 1975, 1982, and 2006. The activist conservative judiciary have waged an unending campaign to undercut the efficacy of the Voting Rights Act, notably in the Supreme Court's 2013 ruling in Shelby County v. Holder, which negated the special provisions articulated in Section 5, and again in 2021, when their ruling in Brnovich v. Democratic National Committee likewise vitiated the stipulations afforded by Section 2. A great deal more nuance is required in order to understand the Act, the protections it affords, and the grounds on which it is opposed and/or critiqued, but the point of force is that the Voting Rights Act is not merely a historical document, but a battleground, regarded by warring factions as unconstitutional, essential, successful, and/or an abject failure.
